These Terms of Service ("Terms") govern your use of this online store and your purchase of products through the store.
By accessing this website or placing an order, you agree to these Terms.
1. About the Store
This store is independently operated by Cross Gray, an independent musician and recording artist.
The store sells music-related merchandise and other products featuring my original artwork, branding, designs, and/or creative content.
Orders for physical merchandise are generally fulfilled by third-party print-on-demand and fulfillment providers. Products are generally produced only after an order is placed.
2. Products and Product Availability
I make reasonable efforts to accurately display product descriptions, photographs, colors, sizes, and other product information.
However, actual colors may vary slightly depending on your device or screen.
Because products are manufactured by third-party fulfillment providers, product availability, materials, manufacturing specifications, and fulfillment locations may occasionally change.
I reserve the right to discontinue or modify products at any time.
If a product becomes unavailable after you place an order, I may contact you regarding an appropriate replacement or refund.
3. Print-on-Demand Fulfillment
Physical merchandise purchased through this store is produced and shipped by third-party fulfillment providers, including Printify and its network of print providers.
This means that I do not maintain physical inventory of the merchandise sold through this store.
Your order information may be provided to the applicable fulfillment provider as necessary to manufacture and deliver your order.
Although third-party providers assist with production and fulfillment, your purchase is made directly from this store, and I remain your point of contact for customer service, refunds, and order-related issues.
4. Orders
When you place an order, you are making an offer to purchase the products in your order.
I reserve the right to refuse, cancel, or limit an order when reasonably necessary, including in cases involving:
- Product availability issues
- Pricing or listing errors
- Suspected fraud or unauthorized transactions
- Errors in customer information
- Fulfillment or shipping restrictions
- Other circumstances that prevent the order from being properly fulfilled
If an order is canceled by me, you will receive a refund for any amount that you have already paid for the canceled order.
5. Pricing and Payment
All prices displayed on the store are subject to change without notice.
I reserve the right to correct pricing errors, including after an order has been placed. If a significant pricing error affects your order, I may cancel the order and provide a refund.
Payment must be successfully received before an order can be fulfilled.
Applicable sales taxes and shipping charges may be added to your order at checkout.
6. Cancellations, Returns, and Refunds
Because merchandise is produced specifically for each order, most physical merchandise cannot be returned or exchanged simply because a customer changes their mind or selects the wrong size, color, or product.

If you need to cancel an order, contact me as soon as possible. Cancellation is not guaranteed once an order has entered production.
7. Shipping and Delivery
Orders are produced and shipped through third-party fulfillment providers.
Production and shipping times are estimates and may vary depending on the product, fulfillment location, shipping destination, carrier, holidays, and other circumstances.
Once an order has been shipped, tracking information may be provided when available.
I am not responsible for delays caused by shipping carriers, customs, weather, natural disasters, incorrect shipping addresses provided by customers, or other circumstances outside my reasonable control.
If your order is lost, damaged, or otherwise experiences a significant delivery problem, please contact me so I can investigate the matter with the applicable fulfillment provider.
8. Customer Information
You are responsible for providing accurate and complete information when placing an order, including your name, email address, shipping address, and payment information.
I am not responsible for orders that cannot be delivered because an incorrect or incomplete shipping address was provided.
9. Intellectual Property
All original music, artwork, photographs, graphics, logos, designs, written content, branding, and other materials appearing on this store are owned by or licensed to Cross Gray, unless otherwise stated.
You may not reproduce, distribute, modify, sell, publicly display, or commercially exploit any store content without prior written permission.
Purchasing a product does not grant you ownership of the artwork, designs, music, trademarks, or other intellectual property appearing on that product.
10. User Conduct
You agree not to use this website or store for unlawful purposes or in a way that could damage, disable, overburden, or interfere with the operation of the store.
You also agree not to attempt to gain unauthorized access to the store, its systems, accounts, or other users' information.
11. Third-Party Services
This store uses third-party services to operate the business, including Shopify for e-commerce functionality and third-party fulfillment providers for the production and shipment of physical merchandise.
Your use of those services may also be subject to the respective provider's terms and policies.
12. Disclaimer
This store and its content are provided on an "as available" basis.
To the extent permitted by applicable law, I make no guarantees that the website will always be available, uninterrupted, error-free, or free of harmful components.
Nothing in these Terms is intended to exclude or limit any consumer rights or protections that cannot legally be excluded or limited under applicable law.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Cross Gray will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this store or your purchase of products through the store.
To the extent permitted by law, the total liability arising from any individual purchase will not exceed the amount actually paid by you for the product giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited under applicable law.
14. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Cross Gray from claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or your misuse of the store.
15. Governing Law
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute that cannot be resolved informally will be handled in a court of competent jurisdiction, subject to applicable consumer protection laws.

I reserve the right to update these Terms from time to time.
The updated version will be posted on this website with a revised "Last updated" date. Your continued use of the store after changes are posted constitutes acceptance of the updated Terms to the extent permitted by law.
